This is a big week for overturning unjust sentencing, as well as final decisions from the Supreme Court as they wind down the release of their findings. The good news is that Julian Assange, a journalist and founder of Wikileaks who was jailed for sharing government secrets, was released under a plea deal. Assange had been imprisoned in the UK or held at the Ecuadorian embassy in London since 2012. Now, he is headed to Australia, his home country.
Assange released things the federal government would rather not have us know, such as:
Video of gunfire from a US helicopter killing civilians in Iraq
Tens of thousands of emails from the Democrat National Committee, plus top Democrats, including Hillary and John Podesta.
Some of these contained references to parties where children were mistreated. This became know as “pizza gate.”
Assange had been in Hillary’s crosshairs for some time. The conservative website True Pundit cited anonymous State Department sources to claim that in 2010, Clinton suggested that they take out Julian Assange. “Can’t we just drone this guy?” she reportedly asked.

Assange’s legal troubles began in 2010, after he released a large cache of documents. He was then charged with rape in Sweden (the charges were dropped). And in 2012, Assange presented himself for asylum at the Ecuadorian embassy. Five years later, a federal grand jury in Virginia indicted him, alleging that he illegally obtained and published classified information about America's wars in Afghanistan and Iraq. Assange was pursued by three administrations: Obama, Trump, and Biden.
As part of this plea deal, he must direct WikiLeaks to destroy any remaining classified material and provide an affidavit once completed.
Assange Sues Mike Pompeo for Spying on Him
Former US Secretary of State and ex-CIA head, Mike Pompeo, has been formally served with a lawsuit alleging he spied on Assange and his visitors while he was at the Ecuadorian embassy in London.
Specifically, he’s accused of providing oversight for a criminal conspiracy to violate 4th Amendment rights of American lawyers and journalists. The CIA and others are listed as co-defendants. According to Tucker Carlson, Pompeo also tried to have Assange killed.
Hope for Steve Bannon
Steve Bannon, who refused to appear before the J6 committee and is now headed to prison, may get a reprieve. House Republican leaders voted to file an amicus—“friend of the court”—brief on his behalf.
The House Bipartisan Legal Advisory Group (BLAG) voted 3-2 that the J6 Committee was illegitimate. Their official legal position is that all subpoenas issued by the committee were also illegitimate.
The Supremes’ Decisions
The Supreme Court is finishing up their work for this session and has released several decisions. Some are more important than others, but all have significance. The votes reveal this is a 3-3-3 court: Leftist, Centrist, and Conservative. Here is a summary:
1. Department of State v Munoz. Background: The Biden administration is trying to give legal status to immigrant spouses of US citizens, including criminal spouses. In the Munoz decision, SCOTUS ruled 6-3 against Sandra Muñoz, a Los Angeles civil rights attorney who couldn’t get her husband’s visa renewed because of his ties to the notorious MS-13 gang. Munoz argued that denying her husband's visa renewal violated her constitutional rights. The Supreme Court holds that there is no fundamental liberty interest held by an immigrant’s legal spouse.
2. Erlinger v. United States. The Court found 6-3 that it requires a jury, not a judge, to determine if a defendant's past crimes happened on different occasions when it impacts the length of the sentence. According to the 5th and 6th Amendments, a unanimous jury is required, and the Court agrees. This decision is notable for President Trump, since the jury in Manhattan split three ways to find him guilty. It also holds importance for the J6 defendants who received severe sentences for misdemeanor crimes. The Court held that sentencing enhancements cannot be arbitrary.
3. United States v. Rahimi. The question here is if gun control measures, such as those involving domestic violence restraining orders, are constitutional under the Second Amendment. The majority ruled 8-1 that an individual may be temporarily disarmed. The lone dissenter was Justice Clarence Thomas.
4. Murthy v. Missouri. Can government officials pressure social media companies to remove content? The Court voted 6-3 that the plaintiffs do not have sufficient “standing,” meaning the case is returned to the lower federal courts. Only Thomas, Alito, and Gorsuch voted to look at the issue. The decision means that various states were not harmed by government and big tech working together to censor content.
The White House was pleased. The administration says they will continue working with tech companies to censor mis/disinformation.

In a rare move, the Supreme Court has extended its term into July, suggesting some of the remaining cases are taking longer than expected. The others are:
Fischer v. Department of Justice: Are there limits on the use of obstruction charges in J6 cases—was the statute used to imprison the defendants stretched too far?
Loper Bright Enterprises v. Raimondo: Who has the power to interpret ambiguous law—is it federal agencies or the courts?
Moody v. NetChoice: Can states regulate social media to stop censorship? This one and Loper Bright could be decided as one case.
Moyle v. Jackson Women’s Health Organization: How far can states regulate or restrict abortion?
Trump v. Vance: Is a sitting or former president immune from criminal subpoenas levied by the states?
Presidential Debate Thursday
The first presidential debate is scheduled for Thursday evening. Biden won the coin toss and was allowed to select either:
Podium position, or
Order of answering questions
Team Biden chose the podium position, causing many to scratch their heads, since answering last and leaving a good impression is imperative.
CNN is holding the debate with hosts Jake Tapper, who compared Trump to Adolf Hitler before World War II, and Dana Bash, whose husband is one of the 51 spies who lied about the veracity of Hunter’s laptop. Microphones will be cut off between answers, and Joe will be allowed to sit throughout the 90 minute debate. There will be no audience.
Why this Matters: Biden has been at Camp David for several days and will remain there until the debate. He needed a week to prepare! It’s likely that the Biden campaign has already forwarded the pre-determined questions to CNN.
Will Biden be replaced if he performs poorly in the debate? One theory is that he is such a good liar, and has had so many years of practice, that would be foolish. Here’s an interesting take on that question from X:
“Only Biden could spend 2020 campaigning on opening the border, on not deporting anyone, spend three years ignoring the problem, and then spend this year blaming it on Trump. That is not as easy to do as people think. Only Biden could look into the camera and claim that inflation was at 9% when he took office. The average sleazy politician can't do what Biden does. Even the worst politicians have some limits…
“The only politician alive with close to Biden's ability to passionately and shamelessly lie like him is Nancy Pelosi. These two are world class, miles ahead of other democrats. The best to ever do it.
“Biden will win the debate because the media has already decided he will win the debate. He will accuse Trump of doing everything that he is doing… He has zero conscience, there is nothing there. Don't underestimate that, it's more rare than people think. Biden is the best to ever do what he does.”
How to Pray: For Steve Bannon, that he will not go to prison; pray also that Peter Navarro will be released. Ask God to have mercy on the J6 defendants still behind bars. Pray for Donald Trump to take the high road on Thursday night and that people will see through Biden’s lies—because some will. Thank God for the three reliable conservatives on the Court: Thomas, Alito, and Gorsuch. Pray Donald Trump will be sitting in the White House in January with the ability to appoint more just like them.
