The Supreme Court rocked history today, finding 6-3 that the president cannot properly defend the USA and serve the people unless he has immunity from prosecution. He is allowed to question the results of an election, meet with his advisors, and listen to advice from his legal counsel with no fear of reprisal. The Court created a new test for presidential immunity and dissolved several of special prosecutor Jack Smith’s cases against Trump. This also destroys the “insurrection” narrative.
President Biden isn’t happy. He delivered a short, angry speech Monday evening in protest of the Court’s ruling. “I know I will respect the limits of presidential power,” he stated, seemingly oblivious to his very recent declaration that the government would forgive student loans—even though SCOTUS ruled he may not, under the Constitution. Biden slammed Trump and slammed the Court, saying they made it legal for Trump to ignore the law.
Let’s see if that’s true.
Justices Thomas, Alito, Gorsuch, and Kavanaugh joined the majority opinion to give Trump immunity. Amy Coney Barrett joined all but one part. They determined that a president, whether past or present, has:
Absolute immunity for core constitutional acts and in interactions with Department of Justice officials
Presumptive immunity over official acts
No immunity concerning unofficial acts
They also found that he cannot be judged by his intent.
The ruling in part reads:
“Whenever the President and Vice President discuss their official responsibilities, they engage in official conduct. Presiding over the January 6 certification proceeding at which Members of Congress count the electoral votes is a constitutional and statutory duty of the Vice President... The indictment’s allegations that Trump attempted to pressure the Vice President to take particular acts in connection with his role at the certification proceeding thus involve official conduct, and Trump is at least presumptively immune from prosecution for such conduct."
Federal judges and Members of Congress are immune from criminal prosecution for their official acts, and so is the President.
Special Prosecutor Jack Smith Rebuked
In his opinion, Justice Thomas chastised Jack Smith's appointment as special counsel. He wrote: "If this unprecedented prosecution is to proceed, it must be conducted by someone authorized to do so by the American people." Smith was an appointee of the Department of Justice.
Legal analyst Jonathan Turley writes that this was the last thing Smith wanted:
"In reading through this opinion, I can't see how this doesn't induce cardiac arrest in the special counsel...The court is imposing a very significant burden on Jack Smith when this goes back to the judge."
What’s Next
The Supreme Court said that Trump’s pressure on Vice President Mike Pence to not certify is “presumptively” immune. Prosecutors would have to prove it was not. On the state level, where the Republican party made a slate of alternate electors, lower courts would analyze what of that conduct was an official act and what was not.
Smith may choose to proceed and take the case back to US District Judge Tanya Chutkan in Washington, DC. She would hear arguments and witness testimony, and evaluate evidence. In the meantime, Trump would be able to file appeals. This could take months.
If the J6 “insurrection” case goes back to the lower court, Jack Smith will have to prove Trump did not act in his official capacity as President when he questioned the election results, but as a candidate. Trump will argue that it was his constitutional duty as commander-in-chief to ensure that the laws are enforced. Chief Justice Roberts said the lower courts may parse what was said and written by players in the organizing, etc., of the January 6th rally. They would then decide which of those communications are immunized.
Smith may also try to move faster by refiling the indictment to omit violations related to Trump’s official duties.
Why this Matters: The Left is panicked. They are crying foul on social, suggesting Biden—who is now immune from prosecution—take matters into his own hands to stop Trump. One large accounted said he should order the military to take action against Donald Trump with a drone strike. Another said Biden should cancel the election and order the military to keep him in power. Another opined that Biden can have the Supreme Court Justices lined up in front of a firing squad. Who wants to tell them that would be an unofficial act outside the constitutional scope of the office of the President?
Rep. Alexandria Ocasio-Cortes is threatening to bring impeachment charges against the six Justices, whom she says are consumed by a corruption crisis. She has forgotten or pretends not to know that President Obama is also protected with this ruling. He will not have to face imprisonment for his drone strike of two American citizens in Iraq—nor will Biden fear prosecution for his release of violent criminal illegals into the heartland.

After Biden’s disastrous performance at the debate, White House insiders admitted to Axios reporters that the President is not able to engage mentally except for a few hours every day. He has a lucid period from 10 a.m. to 4 p.m. The family met at Camp David over the weekend to consider his path forward following excoriating comments from the media and fellow Democrats. Politico reports that Biden’s family privately trashed his top campaign advisers, blaming them for Biden’s flop. The family urged the President to fire or demote them.
Despite calls for him to step aside, Biden will continue with his second term aspirations. Hunter Biden was especially adamant that his father stay the course.
On Monday, Nancy Pelosi and others agreed, and the DNC is right with them. The credentials committee meets July 21 and will be finalizing procedures to nominate Biden even before the August convention in Chicago.
Bloomberg reported:
"The plans to nominate the president early could serve another purpose: helping to quell talk of a potential replacement or an open convention following Biden’s cataclysmic debate against Donald Trump.”
Why this Matters: However sad this is for our country, this is great news for Donald Trump. All of the swing states—including Michigan—are Trump country, and even New Jersey, New Hampshire, and New York are leaning toward the former president.
How to Pray: God has heard our prayers! Praise and thank Him for this gift of justice. Pray for justice for the J6 defendants, Peter Navarro, and Steve Bannon. Pray that the Lord continues waking people up. Pray for repentance.
