Judge Paul Engelmayer bowed to Democrats on Friday night, placing a temporary restraining order (TRO) that keeps Treasury Secretary Scott Bessent, Elon Musk, and his team from evaluating payments at the Treasury Department. This comes after a continual release by DOGE of findings exposing an appalling amount of waste and fraud in government bureaus.
Treasury systems had been accessed by DOGE for two weeks at the time the judge issued his TRO. The complaint was 60 pages, plus a 40-page memorandum, plus a short “affirmation,” which likely took some time to prepare. The judge was chosen on purpose, since the plaintiffs knew that by submitting it on Friday night, the emergency duty judge would be the one handling the case. On weekdays during working hours, cases are randomly assigned.
The lawsuit, brought by 18 US states, was filed in the Southern District of New York—where Trump has been prosecuted many, many times. The face of the lawsuit is New York Attorney General Letitia James, who campaigned on a promise to "Get Trump." She was jubilant in announcing the TRO, saying “no one is above the law.”
The lawsuit challenges a “new policy” by the Treasury to expand access to the payment systems of the Bureau of Fiscal Services to political appointees and special government employees. The States argue that this policy violates the Administrative Procedure Act.
What’s lacking:
Standing—meaning the States must prove they have been hurt. No mention of irreparable injury or imminent harm in the lawsuit
The Court ruled without any analysis of what DOGE is doing
President Trump was kept out of the proceedings
The judge’s temporary restraining order permits two DOGE staffers to have “read only” access.
Vice President Vance responded to this by writing the following:
Harvard law professor Adrian Vermeule calls this “judicial interference with legitimate acts of state, especially the internal functioning of a co-equal branch, is a violation of the separation of powers.”

Federal Judge in DC stopped the Bureau of Prisons from moving men out of women's prison. This judge finds that even if there is "some deleterious effect on privacy and security" [of women], the "balance of the equities...favor the plaintiffs" [men].
The AFL-CIO asked a judge to block Elon Musk's DOGE from accessing Department of Labor systems because such an action could give "sensitive information about investigations into his companies.” An $8.3 million payment was made by USAID to the Solidarity Center, controlled by the AFL-CIO.
Next Stop: Department of Education
President Trump was interviewed by Fox News’ Bret Baier, who asked, “Bottom line, you say you trust [Elon]?"
Trump: "Trust Elon? He's not gaining anything. In fact, I wonder how he can devote the time to it. Oh! He's so into it. But I told him do that, then I'm gonna tell him very soon, like, maybe in twenty-four hours, to go check the Department of Education… and then the military. We’ll find hundreds of billions of dollars of fraud and abuse.”
In preparation for audits of the FBI, CIA, and DOD, DOGE is taking on 45 new staffers. Musk and DOGE have no access to a citizen’s personal information.
Worst Offenders
Democrats are deeply troubled by President Trump’s actions through Musk and DOGE, but they are just getting started. We looked at the abuses by USAID, which were very bad, but it’s going to get worse as each department is laid bare.
Last week we also learned that the federal government made $236 billion in improper payments during the last fiscal year. About $186 billion, or 79 percent, of such errors were concentrated in five areas:
Medicare $51.1 billion
Medicaid $50.3 billion
Pandemic Unemployment Assistance $43.6 billion
The Earned Income Tax Credit $21.9 billion
Paycheck Protection Program Loan forgiveness $18.7 billion
Another $50.1 billion in improper payments went to “other” programs.
Social Security Fraud
Musk also revealed that the Social Security database is not “de-duplicated,” meaning the same number can be used many times over, which enables massive fraud. Musk was told that $100 billion of entitlement payments are being made each year to individuals with no SSN or even a temporary ID number. One lawyer who prosecutors social security fraud admits that only 5 percent of these cheats are caught.
Besides showing corruption in the executive branch, the team has exposed the failures of Congress. For example, the House and Senate has provided $516 billion in appropriations this fiscal year to programs that are expired.
Why this Matters: DOGE is simply a rebranding of the US Department of Digital Services (USDS), which was designed to create better software to run the government. Now DOGE wants to audit the software, which reveals everything that’s going on with our tax dollars. In addition, DOGE will make the software more efficient, eliminate redundancy, and give President Trump a full overview of every agency.
The argument from Democrats is that Elon Musk and DOGE are not elected nor Senate confirmed, but simply appointed. It’s very interesting that the judges temporarily halting the audits and executive orders aren’t elected or confirmed, but simply appointed.
Victories
President Trump terminated the chairman of the Kennedy Performing Arts Center in DC and appointed himself as the new chairman—immediately banning drag shows targeting youth.
Trump signed an Executive Order protecting Christians from the government. He stated, “After years of decline, Americans are re-asserting our true identity as a people ordained by God to be the freest and most exceptional nation ever to exist on the face of the Earth."
US military deployed 300 troops to Guantanamo Bay to construct migrant facilities, and the first planeloads of prisoners have already been delivered.
Housing and Urban Development Secretary Scott Turner halted any pending or future enforcement actions related to HUD’s 2016 Equal Access Rule, which, in essence, tied housing programs, shelters and other facilities funded by HUD to far-left gender ideology.
New York Enshrines Abortion
Governor Kathy Hochul signed a bill into New York law that protects any doctors who illegally prescribe abortion pills to pregnant moms, by keeping their names secret. The law states that doctors’ names must be kept off the prescription bottles—which means that they can provide tele-health services to patients in pro-life states.
How to Pray: That the courts will eventually side with the President and allow him to do the job as stated in the Constitution. Pray for pregnant women everywhere that God would turn their hearts of stone into hearts of flesh. Praise God for a new chapter in American politics and the progress in reclaiming our nation back.
