Tuesday morning, Hunter Biden was all set to present himself before the judge. He was about to enjoy the benefits of being the “first son” of a Democrat president. First, he wasn’t going to get in trouble for $2 million in tax fraud. Nor was he going to spend ten years in prison for a felony weapons charge. And even better still, he was going to receive protection from future prosecution for his myriad of other crimes.
It was all so simple! Until an irate Republican Congressman raised an alarm and the defense team made a deceptive phone call—and a judge decided to actually do her job. You see, judges are supposed to preserve the integrity of the court, and this judge smelled something fishy.
That’s how Hunter lost his sweet deal!
Let’s look at the series of events that set Hunter Biden on the path to a revised deal or a jury trial.
Questions Raised, Trickery Afoot?
1. Rep. Jason Smith (R-MO), a GOP lawmaker on the Ways and Means Committee who was troubled by the government handling of Hunter Biden’s case, sent a “friend of the court” brief to the Judge. In it, he complained that the plea deal was too lenient and it was tainted by political interference.
He wanted the plea deal thrown out.
2. Tuesday evening, an attorney on Hunter’s defense team called the court clerk, asking that some of the IRS witness testimony be removed from the court docket. The clerk reported that the caller, Jessica Bengels, presented herself as being on the staff for the prosecutor’s office. Actually, Bengals is a litigation services counsel for the defense, Latham & Watkins.
3. The Judge was told and ordered Hunter’s attorneys to explain themselves by 9 a.m. Wednesday, or be sanctioned.
4. Just before the deadline, Latham & Watkins lawyer Matthew Salerno responded that it was “an unfortunate and unintentional miscommunication.”
It was an “oopsie!”
Protected from Prosecution
Clearly, Hunter Biden has been protected throughout this process. His top lawyer, Chris Clark of Latham & Watkins, is a close personal friend of President Biden’s choice for acting head of the DOJ’s criminal division. Clark and Nick McQuaid were partners at L&W. The GOP contacted Biden’s Department of Justice five times, concerned about the conflict of interest. Nothing was done.
Clark clearly thinks his client is not to be touched.
He told prosecutors on a call that if they charged Hunter, they’d be committing career suicide.
Clark was contacted by the Daily Mail for comment last August on Joe Biden’s meeting with two Chinese energy executives in 2014.
Clark responded to the Daily Mail reporter, “Please quote me. Josh you are a parasite who lives [off] other people’s difficulties…”
Despite insisting that father and son never combined business interests, VP Joe Biden met with these Chinese businessmen and other associates of Hunter's 15 times. A client of Hunter’s company Seneca Global Advisors partnered with the Chinese on a $1.25 billion natural gas plant in China. Hunter also invested in a car company that was bought by these same Chinese executives.
Judge Questions One-of-a-Kind Sweet Deal
Hunter and his lawyer appeared before Judge Maryellen Noreika in a Delaware courtroom Wednesday. She asked them a series of questions:
Why did the deal include a felony gun charge with misdemeanor tax charges? There's no precedent for a plea deal where defendant gets pretrial diversion (aka dismissal) of a felony gun charge.
Why did the deal include immunity from other possible crimes, including not registering with the US as a foreign agent? This is called a “global plea,” an agreement that prevents other charges in the future.
She asked Hunter about his agreements with foreign companies.
He recited a list of his clients.
Judge Noreika shocked them all by refusing to rubber-stamp this deal, saying she can neither accept or deny his guilty plea due to ambiguities. It left Hunter and his lawyers with little choice accept to decline to make any concessions. He changed his plea to “not guilty.” Will they come up with another deal, or will the case go to trial?
It Gets Even Worse for Hunter
Judge Noreika made life even worse for Hunter, adding stipulations and threatening to have him arrested if he fails to comply. She ordered: “Violating any of the foregoing conditions of release may result in the immediate issuance of a warrant for your arrest, a revocation of your release, an order of detention, a forfeiture of any bond, and a prosecution for contempt of court and could result in imprisonment, a fine, or both.”
If Hunter consumes alcohol or drugs including marijuana, he will be arrested and prosecuted for contempt of court.
Remember, Hunter is a lifelong addict. He was recently seen visiting the apartment where his lawyer/fixer, Kevin Morris, was on the balcony smoking a bong. Morris paid Hunter’s $2 million tax bill.
He must find a job, submit to random testing for drugs and alcohol, be in a substance abuse program, and must not possess a firearm.
Why this Matters: Judge Noreika questioned Hunter and his lawyers as to whether he was sober when he continued to make errors filing his taxes through 2018-2019. They conceded he was sober, which speaks to intent and suggests the Judge may not agree to recommended no jail-time at sentencing.
How to pray: Thank God for He is the righteous judge—and thank Him for this representative of His character, Judge Noreika! Pray that for his own sake, Hunter Biden goes to prison. Pray that Joe Biden would stop lying and step down before he is impeached. Pray for God to forgive us for turning a blind eye when our leaders commit such crimes.
Never Doubt the Kindness of Americans!
Marine Corps Sgt Nicole Gee died during the Afghanistan withdrawal in 2021. Her body was transported to Roseville, California for a ceremony but the Pentagon then denied the family's request to move her to her final resting place, Arlington National Cemetery. This is a new DOD policy that was part of the National Defense Authorization Act. That left the family with a $60,000 bill. After a desperate search for funding, a non-profit called Honoring Our Fallen, stepped in and arranged to transport her body via a private jet.
Praise the Lord! Thank you Father, for Sgt Gee and her service to this nation.
