The Georgia ruling in the disqualification hearing for Fulton County DA Fani Willis was released this morning. Judge Scott McAfee ruled that either Fani Willis fires her former lover Nathan Wade, and keep the case—or she steps down from the prosecution. By the end of the day, Wade had resigned.
Willis responded by praising Wade, stating she will always remember him for being “brave enough to step forward and take on” the election interference case.
McAfee’s ruling said the defendants had not proven there was misconduct, but only the appearance of impropriety, but said that “an odor of mendacity (deceit) remains.”
This is what Willis has allegedly done:
Hired her boyfriend to prosecute Trump before the start of the case
Paid him twice as much as other lawyers, even though he isn’t qualified
Went on lavish vacations together, with him footing the bill, then claiming to have paid him back with “piles of cash” she has laying around the house
Labeled as inconclusive the geo-location and phone calls/text data that shows multiple middle-of-the-night rendezvous, even though her office regularly relies on the same data to convict criminals
Lied repeatedly to the judge
McAfee wrote that Wade and Willis testified untruthfully, even suggesting that the Georgia Bar investigate. He also admonished Willis for accusing the defendants of racism when speaking about the case in an MLK-day sermon at Bethel AME Church.
His ruling effectively put a stay on the case until Willis resolves the appearance of impropriety.
The prosecution suffered a blow on Wednesday, when Judge McAfee threw out six counts of the indictment. These concern efforts by the defendants to solicit public officials to violate their oaths of office. The counts were unspecific, and McAfee wrote, "They do not give the Defendants enough information to prepare their defenses intelligently.”
Despite this apparent loss, here’s what may still happen to Fani Willis and the case:
Trump and his co-defendants may file motions against the ruling because McAfee grants that the law is a little unsettled in this area.
If the Court of Appeals rules differently, any convictions may be tossed because of Willis’s misconduct.
Fani could be charged with contempt of Congress.
Rep. Jim Jordan (R-OH), Chairman of the House Judiciary Committee, issued a subpoena for her to surrender records related to her use of federal funds that were earmarked for a building that wasn’t built. The records were due February 2, and she has so far refused to comply—so Jordan threatened to hold her in contempt of Congress.
The $488,000 given by the DOJ in 2020 was meant to be used for the creation of a youth advocacy center and gang prevention program. The center never opened. Instead, Willis’ department purchased “swag” (ad specialties), MacBooks, and travel.
When a whistleblower tried to expose the misuse, Fani had her fired and escorted from the building.
Willis responded to Jordan by calling the subpoena “over broad and unduly burdensome.” She has until March 28 to turn over all documents requested. She also insisted the spending of federal funds was compliant.
Willis could be prosecuted by the State of Georgia
Georgia Gov. Brian Kemp has signed legislation empowering the state Prosecuting Attorneys Qualifications Commission to remove prosecutors or impose other sanctions, on persons such as Willis, for misconduct.
Kemp stated: “This legislation will help us ensure rogue and incompetent prosecutors are held accountable if they refuse to uphold the law."
Allegedly, Georgia Bureau of Investigation (GBI) has been interviewing Fani’s colleagues, past cases defense attorneys and most recently Governor Brian Kemp. A defendant’s private investigator is cooperating with the GBI on potential bribery allegations in drug cases.
Trump’s Manhattan Trial Delayed
Trump's criminal trial is supposed to begin in New York on March 25. This is the case alleging Trump committed fraud through bookkeeping entries in the hush money payments to Stormy Daniels. Thursday, Manhattan DA Alvin Bragg agreed with Trump’s defense that the trial should be delayed because the Justice Department just produced tens of thousands pages of documents that Bragg's office supposedly requested more than a year ago. Some have been delivered, but more are coming.
Bragg is seeking a 30-day delay to the start of the trial in order to process these documents. He is blaming Trump’s defense team for the delay.
Why this Matters: Is this a stalling tactic? Lawyer Alan Dershowitz called it a the weakest case of all. He told Fox Business:
“This is the first case in history anybody has ever been tried on this kind of made-up case, so it’s the weakest case of all, and now he is prepared to have a delay, but that case may get tried first, and it’s New York so there will be a conviction in Manhattan, you know, a jury in Manhattan will convict a ham sandwich if its name is Trump,” Dershowitz, a retired Harvard law professor, continued. “So I think there will be a conviction and, very likely, a reversal on appeal, but the reversal on appeal may not come until after the election.”
Florida Documents Case - Arbitrary Enforcement
As expected, Judge Eileen Cannon denied President Trump's motion to dismiss the case where he is accused of mishandling classified documents. This is one of two motions that were debated on Thursday. His lawyers had argued that the Espionage Act is unconstitutionally vague when applied to a former president.
Cannon said some of Trump’s arguments warrant serious consideration, but added that no judge has ever found the statute unconstitutional. She denied the motion so it could be raised later, “as appropriate in connection with jury-instruction briefing and/or other appropriate motions."
She also recognized arbitrary enforcement. In other words, is it justice to charge Trump under the Espionage Act, but not use it against Biden, the Clintons, etc.?
